Why Signage Permits Are More Complicated Than They Look

A sign going up on a building in New York City isn't as simple as mounting it and turning it on. The NYC DOB requires permits for most commercial signs, and the rules around size, illumination, zoning district, and placement are strict. Get it wrong and you're looking at a violation, a stop work order, or a sign that has to come down.

When Is a Signage Permit Required?

In NYC, a permit is generally required for any sign that is:

  • Illuminated (internally or externally)
  • Over 6 square feet in area
  • Projecting from a building facade
  • On a scaffold, bridge, or sidewalk shed
  • A roof sign
  • An advertising sign (as opposed to an accessory sign)

Even signs that seem minor can trigger permit requirements depending on the zoning district and building classification. When in doubt, assume a permit is needed.

Types of Sign Permits in NYC

The DOB distinguishes between several sign categories, each with different requirements:

  1. Accessory Signs
    • Identifies the business at the location
    • Size limits vary by zoning district
    • Must comply with NYC Zoning Resolution sections 42-52 and 32-60
  2. Advertising Signs
    • Promotes a business or product not at the location
    • Heavily restricted, not permitted in most residential and commercial zones
    • Requires additional DOB scrutiny and often community board review
  3. Illuminated Signs

The Sign Permit Filing Process

1. Zoning Analysis Determine the zoning district, building use, and applicable sign regulations. This determines what type of sign is permitted and at what size.
2. Drawings Preparation Prepare DOB-compliant drawings showing sign dimensions, placement, materials, illumination method, and structural attachment details.
3. PE Sign-Off (if required) Projecting signs, roof signs, and signs over certain sizes require a licensed PE to stamp the drawings.
4. DOB NOW Filing Submit the application through DOB NOW: Build. Applications are reviewed by a DOB plan examiner.
5. Permit Issuance & Installation Once approved, the permit is issued. Work can begin. A final inspection may be required depending on sign type.
6. Signoff & Close-Out After installation, any required inspections are completed and the job is signed off.

What Is a PE Sign-Off and Why Does It Matter?

A Licensed Professional Engineer (PE) is a state-licensed engineer authorized to stamp and seal drawings submitted to the NYC Department of Buildings. When the DOB requires a PE stamp, it means they need an engineer to certify that the proposed work is structurally sound and code-compliant.

Without the required PE sign-off, your application will be rejected, no exceptions. This is one of the most common causes of permit delays we see at CCB.

Projects That Always Require a PE

Navigating HPD Compliance
for Property Owners

What Is HPD and Who Does It Affect?

The NYC Department of Housing Preservation and Development (HPD) is the city agency responsible for maintaining and enforcing housing quality standards across New York City's residential buildings. If you own a residential property with three or more units, HPD has jurisdiction over your building, and the requirements are significant.

HPD violations can affect your ability to refinance, sell, or rent your property. They can also result in civil penalties, emergency repair charges billed to the owner, and in serious cases, litigation.

Types of HPD Violations

  1. Class A Non-Hazardous
    • Minor conditions that don't immediately affect health or safety
    • Examples: peeling paint in vacant unit, broken window latch
    • Correction deadline: 90 days
  2. Class B Hazardous
    • Conditions that could harm health or safety if not corrected
    • Examples: inadequate heat, mold, pest infestation
    • Correction deadline: 30 days
  3. Class C Immediately Hazardous
    • Conditions that pose an immediate threat to life
    • Examples: no heat in winter, gas leaks, lead paint hazards
    • Correction deadline: 24 hours (heat/hot water) to 21 days

Annual Registration Requirements

Property owners of buildings with three or more residential units must register annually with HPD. Registration must include current owner information, a managing agent if the owner lives outside NYC, and an emergency contact. Failure to register is itself a violation and can result in civil penalties.

Registration is due every year by September 1st. We help property owners stay current and avoid the penalties that come from lapsed registrations.

How HPD Violations Are Resolved

1. Identify the Violation Pull the full HPD record for your property. Understand the class, description, and deadline for each open item.
2. Correct the Condition The physical condition cited must be corrected by a qualified contractor. Documentation of the repair is essential.
3. Certify Correction File a Certification of Correction with HPD. This is the formal notice that the violation has been addressed.
4. HPD Inspection For Class B and C violations, HPD may send an inspector to verify the correction before dismissing the violation.
5. Violation Dismissal Once HPD confirms the correction, the violation is officially dismissed and removed from your property record.

What Happens If You Don't Act

HPD violations that go unresolved don't disappear, they compound. The city can hire contractors to make emergency repairs and bill the cost to the property owner, often at inflated rates. Persistent violations can trigger litigation, civil penalties, and in extreme cases, proceedings that put the building into receivership.
